Police: Man attempted to damage machine after OVI arrest

PERKINS TWP. — A man arrested for OVI in Perkins Township allegedly attempted to damage police equipment. Daveon A. Davis, 30, of the 1500 block of Camp St., is facing one fifth-degree felony count of attempted vandalism and three misdemeanors: OVI, misconduct at an emergency and no operator's license. Just after 12:30 p.m., officers were called to the 5900 block of Milan Road (U.S. 250) for the report of a two-vehicle crash, according to a Perkins police report. They were able to determine that a 79-year-old woman failed to yield when pulling from a private drive onto Milan Road (U.S. 250). After she pulled into traffic, she was struck by Davis' vehicle, according to the report. While investigating the crash, the officer noted that Davis became turbulent, striking his own vehicle and walking into traffic. At that point, after ignoring multiple police commands, Davis was arrested for misconduct at an emergency. When the officers interacted with Davis, they noted the odor of intoxicating beverages. They informed him of his constitutional rights and he refused to answer if he understood. He also refused to answer when asked if he wanted to participate in field sobriety tests, the report states. Davis' vehicle was towed, and he was transported to the Perkins police station. There, officers asked him to submit a breath sample for testing. Davis reportedly started yelling profanities, threw his copy of a form and started hitting a machine used to test for alcohol in a person's breath. He then allegedly attempted to push the machine off of a table. These machines can run well over $10,000 for a new unit. At that point, Davis was marked as an OVI refusal and transported to jail. As of late Tuesday, Davis is incarcerated in Erie County Jail under a $15,000 bond.
