Cedar Point crash victim files suit

SANDUSKY — A man who was the victim of a hit-skip crash in 2024 has filed suit against the driver who hit him. Kyle Allen, of Cleveland, filed the suit on Wednesday in Erie County Common Pleas Court against Riley Brock, the vehicle's driver, and Christy Chaffin, the vehicle's owner. Both defendants reside in Southgate, Michigan, according to the suit. On May 10, 2024, Brock "negligently, carelessly and recklessly operated the Escalade, running over Mr. Allen and causing him to suffer severe and permanent injuries," according to the lawsuit. Allen is asking for compensatory damages in excess of $25,000 and "interest, costs, attorney's fees and such other and further relief as this court deems just and equitable," the suit states. The crash At about 8 p.m. on May 10, 2024, Sandusky police were called to the main Cedar Point parking lot for the report of a traffic employee who was hit by an SUV and the vehicle fled. Officers discovered Allen with severe leg injuries. A witness told them they saw Allen fall and then a Cadillac Escalade drive over his legs before fleeing the scene, according to a Sandusky police report. Police were able to identify Brock as the driver and he was arrested at a residence in Southgate. He was charged with one fourth-degree felony count of leaving the scene of a private property accident resulting in injury. Brock was then indicted in December 2024 with one count of fifth-degree felony failure to stop after a nonpublic road accident and one first-degree misdemeanor count of assault. In September, Brock entered a guilty plea and was placed in a three-year diversion plan. If he completes diversion, the indictment will be dismissed. If he violates the plan, his guilty plea will be accepted and Erie County Common Pleas Court Judge Beverly McGookey could sentence him to up to one year in prison.
