Jailhouse calls show Overmyer's desperation

PERKINS TOWNSHIP— Jail house phone calls between Kyle Overmyer, his family and additional calls to his girlfriend reveal a very desperate and troubled man.Overmyer, soon after being booked into the Erie County jail to await his prison assignment, did not realize the gravity of his situation. He repeatedly assures his family and his girlfriend that he expects to get "shock probation" six months from when he started to serve his sentence at the end of December."I can apply for judicial release in six months as long as I am good. I am going to do programs and I can get out," Overmyer said.But that's not correct."He is not subject to judicial release (the same as shock probation). He has to serve the jail time," said Andrew Mayle, of the law firm Mayle and Mayle, which represented Overmyer.Mayle said that laws do not allow for early release when government officials are convicted of certain crimes. When Overmyer, as a public official, admitted guilt to a charge of theft in office those laws barred him from early release."He is paying his debt to society. Once out he plans on making the best out of a negative situation," Mayle said.Overmyer in a recorded phone call questions whether he will continue to live in Sandusky County when he is released.He muses that he plans to reach out to former Ohio State star running back Maurice Clarett for guidance.Clarett, who was a draft possibility for a professional football team before he was convicted of an aggravated robbery in Columbus, now travels as a motivational speakerOvermyer in several calls to his girlfriend, who he said he's known for 20 years, sought assurances from his her that she would stand by him. They discussed her status as the girlfriend in his life.Listen to a portion of a phone call below[toutembed=4yw792]"Are you OK," Overmyer asked."Yes I am going to be OK," she replied."Are you going to stand by me," Overmyer asked"Yes," she replied."You promise," he seeks confirmation again."Yeah, but I need to know," she said."I told you I am not going to lie to you," he said.But in later conversations with his wife Overmyer was vague about his relationship with the woman, which it appears his wife and children had just found out about.He repeatedly sought assurances that his wife and his children were staying beside him."You don't support me," he stated.She was not offering solace so quickly."I have not said one bad thing about you. I have not trashed you in public or to your kids," his wife said. "Your kids deserve a good dad."She told him to pursue his relationship with the other woman. "If you like her follow her. I am not holding you back," his wife said.In different calls to both women Overmyer admitted he had been addicted to his medications.Overmyer's girlfriend asks him if he took pills from the prescription drop off boxes at area police stations, the accusation that launched the investigation that led to his downfall. ."I looked in there. My conscious killed me but I did not do it," Overmyer tells her.She then asked Overmyer if he did use multiple doctors to obtain prescriptions."I was in denial, Yes I did," Overmyer tells her. "I was ashamed of myself." "I know honey. It's hard to admit when you have a problem like that," his girlfriend said.In one phone call family asked him if he had a drug problem."I had a drug problem," Overmyer admits."Are you still addicted?""You still think about them but I don't do them," Overmyer said.Former Sheriff Kyle Overmyer could be spending Christmas in jail. His attorney asked for delay in sentencing until January.
