Man, shot by neighbor, charged with voyeurism

Schindley, with attempted aggravated burglary and voyeurism on Monday.David SchindleyA search of Schindley's cellphone revealed more than 50 videos of residences, seemingly shot with the cellphone held closely to outdoor windows and peering into bedrooms, bathrooms and other living spaces, Chief Deputy Jared Oliver said. Many of the videos seem to have been taken through closed blinds.An approximately 10-second video outside a home on the 500 block of Bald Eagle Drive seems to correspond to the moments before the homeowner, Christopher Michaloski, shot Schindley. Michaloski told deputies he believed Schindley, whom he did not appear to recognize at the time, was attempting to break into his home.Oliver said the videos, which range from a few seconds to a minute and a half or so, date back to October at least. Deputies suspect the videos were recorded in the same Huron Township neighborhood where Schindley lived and where he was shot on Sunday night, Oliver said. They were trying to identify the recorded homes, and, in some cases, the individuals recorded inside the homes, on Monday."We're in the process of trying to identify some of these people," Oliver said.He said some of the videos show women "in a state of undress." Others show what appear to be an undressed juvenile boy and an undressed juvenile girl. The children have not yet been identified.A continuing investigation is likely to lead to further charges against Schindley, Oliver said. Authorities seized all computer-related equipment from his home through a search warrant on Monday."We suspect we may find more videos," Oliver said.Authorities began looking into the situation following a report of a shooting in Huron Township around 10:30 p.m. A resident, Jill Michaloski, told a dispatcher that someone was trying to break into her house. She said that her husband, Christopher Michaloski, 41, had fired a gun in response."We were trying to crawl into bed," she told the dispatcher. "I heard someone try to open my patio door and get into my bedroom."Christopher Michaloski then got on the line to clarify the situation, according to a recording of the 911 call. After identifying himself as a U.S. Customs and Border Patrol agent, he calmly explained what happened after he noticed the individual at his door."I went outside," he said, "I said, 'Hey, stop.' (He) came at me, rushed at me. I had a pistol on me. I shot at him."Oliver said Michaloski fired six times. Erie County Sheriff Paul Sigsworth said Michaloski's firearm, a .380-caliber semiautomatic pistol, is legally owned and is not a service weapon through U.S. Customs and Border Patrol.Deputies noted that the screen door of the Michaloski's home, which leads into the bedroom, was open, Oliver said.Shortly after dispatchers sent deputies to the scene there, they fielded another call from Schindley's wife. Erica Schindley told the dispatcher that she needed immediate medical attention for David Schindley, 45, who had returned to their garage on the 1000 block of Eagle Ridge Drive.David Schindley spoke to the dispatcher as well, according to a 911 recording."I was walking around the neighborhood. And it's my fault," he explained. "The neighbors shot at me. They hit me in the leg with a gun."Schindley suffered a gunshot wound to the left thigh, Oliver said. Huron firefighters took him to Firelands Regional Medical Center, where he was treated and released.It was not immediately clear why Schindley was at his neighbor's door on Monday morning. Because he requested an attorney when a deputy spoke to him in the hospital, Oliver said, his only statements to authorities had come in the 911 call.The sheriff's office executed a search warrant at the Schindley's residence around 3:30 a.m. on Monday, Oliver said. There they recovered the clothing he was believed to have been wearing during the shooting and the cellphone on which deputies found the videos on Monday. A later search warrant allowed authorities to seize all computer-related equipment.Schindley was booked into the Erie County jail on Monday. He is being held without bond on charges of attempted aggravated burglary, a second-degree felony, and voyeurism, a third-degree misdemeanor.As the investigation continues, Oliver said deputies anticipate filing additional charges against Schindley. Once they identify the recorded children, he said, this could include a felony charge of pandering obscenity involving a minor.Sigsworth said Schindley is slated for an arraignment on the pending charges in Huron Municipal Court on Tuesday.Sigsworth said there is no indication that Schindley had a weapon when he approached his neighbor's house. Schindley told dispatchers the same, according to the 911 recording. Oliver said he did not appear to be intoxicated, although a toxicology report is anticipated as part of the investigation.Neither Schindley nor Michaloski appear to have criminal records in any of the four municipal courts in Erie County, according to court records. They have been neighbors since at least 2012, according to Erie County Auditor records.Sigsworth thanked the Sandusky and Huron police departments for their assistance in the investigation. Calls started coming into the dispatch center at about 10:30 p.m., the sheriff said.
